1. Introduction
This Acceptable Use Policy sets out the conduct we require of every Buyer and Seller on eBodhya Marketplace, so that the Marketplace remains a trustworthy place to buy and sell educational resources. It exists because a marketplace's value depends on the integrity of its listings, reviews, and transactions, and it binds every User alongside the Terms of Service.
2. Definitions
This Policy uses the shared definitions in Anomaa Studio's canonical definitions list and the Marketplace-specific terms defined in the Privacy Policy Section 2, together with:
- "Incentivized Review" — a rating or review given, or promised, in exchange for payment, a discount, a free product, or any other consideration.
- "Off-Platform Transaction" — a sale, payment, or exchange of contact details intended to complete a purchase of a Digital Product outside the Marketplace's checkout and Payout system.
3. Applicability
This Policy applies to every Buyer and Seller using the Marketplace, including Institution/School purchasers and their provisioned sub-accounts.
4. Legal Entity
eBodhya™ is a trademark owned and used by Anomaa Studio, a sole proprietorship business based in Bengaluru, Karnataka, India ("Anomaa Studio," "eBodhya," "we," "us," or "our"). Anomaa Studio owns and operates the entire eBodhya suite of platforms, comprising:
- eBodhya Studio — studio.ebodhya.in
- eBodhya Marketplace — marketplace.ebodhya.in
- eBodhya Schools — schools.ebodhya.in
- eBodhya Workspace — workspace.ebodhya.in
(together, the "eBodhya Platforms").
Every account, subscription, order, listing, or agreement created or entered into through any eBodhya Platform is an agreement with Anomaa Studio directly. No eBodhya Platform is owned, operated by, or offered on behalf of any third party, franchisee, reseller, school district, or unrelated entity, unless we state so expressly and in writing. eBodhya™ and the eBodhya logo are trademarks of Anomaa Studio; no license to use them is granted except as expressly permitted in writing.
In this document, "the Platform" means eBodhya Marketplace (marketplace.ebodhya.in) specifically, and "eBodhya" or the "eBodhya Platforms" means the wider suite of products described above. Where this document imposes obligations on "Anomaa Studio," those obligations are undertaken by Anomaa Studio in its capacity as operator of the Platform.
5. Prohibited Conduct
You may not, whether as a Buyer or a Seller:
- Fake or incentivized reviews — post, solicit, purchase, or offer an Incentivized Review; post a review for a Digital Product you have not purchased; post multiple reviews from linked accounts to inflate a rating; or offer a Buyer any benefit in exchange for removing or altering a negative review.
- Price manipulation — coordinate with another User to fix, inflate, or deflate prices; use bots to repeatedly change prices to game search ranking; or advertise a price different from the price charged at checkout.
- Listing infringing content — list a Digital Product you do not own or are not licensed to sell, or that infringes a third party's Intellectual Property Rights; see the Copyright Policy.
- Circumventing platform fees / Off-Platform Transactions — direct a counterpart to pay, communicate, or complete a purchase outside the Marketplace in order to avoid commission, taxes, or Buyer protections; include external payment links, phone numbers, or messaging handles in a Listing for this purpose.
- Account sharing and credential resale — share Account credentials with, or sell/transfer access to, a person other than an authorized user under the same License; operate a Seller Account on behalf of an undisclosed third party.
- Scraping — use automated means to extract Listing data, pricing, reviews, or Buyer/Seller information beyond normal browsing, or to build a competing catalog.
- Any conduct otherwise prohibited under the Community Guidelines, Seller Agreement, or Buyer Terms.
6. AI
We use automated fraud, spam, and fake-review detection to identify conduct prohibited by this Policy, as described in the AI Usage Policy. You may request human review of an automated enforcement decision as described in that Policy.
7. Data Processing
Data used to detect and enforce against prohibited conduct is Processed under the Privacy Policy.
8. Cookies
Not separately applicable; see the Cookie Policy.
9. Third-Party Services
Fraud and abuse detection may draw on signals from payment and analytics processors identified in the Privacy Policy.
10. Security
Account-sharing and credential resale (Section 5.5) are also security violations; see the Security Statement.
11. Retention
Evidence of a policy violation (reports, flagged content, enforcement history) is retained as described in the Data Retention Policy, including for as long as needed to defend against a related dispute.
12. Deletion
Enforcement records may be retained after Account deletion to the extent necessary to prevent re-registration by a repeat offender, consistent with the Data Deletion Policy.
13. Intellectual Property
Listing infringing content (Section 5.3) is addressed under the Copyright Policy and Copyright Takedown Policy.
14. User Responsibilities
You must report suspected violations of this Policy to support@ebodhya.in, cooperate with any investigation, and ensure that any sub-account you provision (for example, as an Institution) also complies with this Policy.
15. Enforcement Ladder
We enforce this Policy proportionately, escalating as follows, though we may skip steps for serious or repeat violations or where required by law or a valid takedown notice:
- Warning — a notice describing the violation and requiring correction within a stated period.
- Content removal — removal of the offending review, Listing, or message.
- Feature restriction — temporary suspension of reviewing, messaging, listing, or Payout privileges.
- Account suspension — temporary suspension of the Account pending investigation or correction.
- Account termination — permanent termination of the Account and removal of all Listings, for serious, repeated, or uncorrected violations, or fraud.
- Withholding of Payouts — where a violation involves fraud, fake reviews benefiting a Seller, or a chargeback dispute, pending Payouts may be withheld as described in the Seller Agreement and Creator Revenue Policy.
You may appeal an enforcement action as described in the Community Guidelines.
16. Limitation of Liability
Our liability for actions taken (or not taken) under this Policy is limited as described in the Terms of Service.
17. Disclaimer
Automated detection of fake reviews, price manipulation, or off-platform circumvention may produce false positives; you may request human review as described in the AI Usage Policy.
18. Termination
Termination for violation of this Policy is governed by Section 20 of the Terms of Service and the enforcement ladder above.
19. Governing Law and Dispute Resolution
This Acceptable Use Policy and any dispute, claim, or controversy arising out of or relating to it, the Platform, or the Services (a "Dispute") is governed by the laws of India, without regard to its conflict-of-laws principles.
The parties will first attempt in good faith to resolve any Dispute through informal negotiation for thirty (30) days after one party gives the other written notice of the Dispute. If the Dispute is not resolved within that period, it will be referred to and finally resolved by arbitration in Bengaluru, Karnataka, under the Arbitration and Conciliation Act, 1996, before a sole arbitrator appointed by Anomaa Studio. The arbitration will be conducted in English, and the seat and venue of arbitration will be Bengaluru, Karnataka. The award of the arbitrator will be final and binding on the parties.
Nothing in this clause prevents either party from seeking urgent injunctive or equitable relief before a competent court at any time. Subject to the arbitration agreement above, the courts at Bengaluru, Karnataka shall have exclusive jurisdiction over any Dispute not subject to arbitration and over any proceeding to enforce an arbitral award.
20. Jurisdiction
Without prejudice to the arbitration agreement above, the Platform is directed at Users in India, and Anomaa Studio makes no representation that the Platform or its Content is appropriate or lawfully available in other locations. Users who access the Platform from outside India do so on their own initiative and are responsible for compliance with local law.
21. Changes to This Policy
We may update this Policy from time to time to reflect changes in the Services, Applicable Law, or our practices. We will post the revised version on the Platform with an updated "Effective Date" and, for material changes, will provide reasonable advance notice through the Platform, by email, or by an in-product notice, as appropriate to the change and the audience of the Platform. Continued use of the Platform after the revised Policy takes effect constitutes acceptance of the changes. Where Applicable Law requires your express consent to a change (for example, a material change to how we Process Personal Data of a Child), we will seek that consent before the change takes effect.
