1. Introduction
This Intellectual Property Policy explains who owns what on eBodhya Marketplace: Listing Content, the limited rights Anomaa Studio needs to display and market that Content, the license a Buyer receives on purchase, and the rules for using the eBodhya™ trademark. It exists to keep ownership clear between Sellers, Buyers, and Anomaa Studio.
2. Definitions
This document uses the shared definitions in Anomaa Studio's canonical definitions list and the Marketplace-specific terms defined in the Privacy Policy Section 2, together with:
- "Marketing License" — the limited, non-exclusive license described in Section 6 that a Seller grants Anomaa Studio to display, reproduce, and promote a Listing on and through the Marketplace.
3. Applicability
This Policy applies to all Listing Content, User Content, and the Marketplace's own software, design, and branding, across Buyers, Sellers, and Institution/School purchasers.
4. Legal Entity
eBodhya™ is a trademark owned and used by Anomaa Studio, a sole proprietorship business based in Bengaluru, Karnataka, India ("Anomaa Studio," "eBodhya," "we," "us," or "our"). Anomaa Studio owns and operates the entire eBodhya suite of platforms, comprising:
- eBodhya Studio — studio.ebodhya.in
- eBodhya Marketplace — marketplace.ebodhya.in
- eBodhya Schools — schools.ebodhya.in
- eBodhya Workspace — workspace.ebodhya.in
(together, the "eBodhya Platforms").
Every account, subscription, order, listing, or agreement created or entered into through any eBodhya Platform is an agreement with Anomaa Studio directly. No eBodhya Platform is owned, operated by, or offered on behalf of any third party, franchisee, reseller, school district, or unrelated entity, unless we state so expressly and in writing. eBodhya™ and the eBodhya logo are trademarks of Anomaa Studio; no license to use them is granted except as expressly permitted in writing.
In this document, "the Platform" means eBodhya Marketplace (marketplace.ebodhya.in) specifically, and "eBodhya" or the "eBodhya Platforms" means the wider suite of products described above. Where this document imposes obligations on "Anomaa Studio," those obligations are undertaken by Anomaa Studio in its capacity as operator of the Platform.
5. Ownership of Listing Content
Ownership of the Intellectual Property Rights in a Listing's Content stays with the Seller (or the Seller's licensor) at all times. Listing a Digital Product on the Marketplace does not transfer copyright, and Anomaa Studio does not become the owner, co-owner, or publisher of a Seller's Content merely by hosting or selling it, except for a Listing expressly marked as an Anomaa Studio-Published Product.
6. Marketing License Granted to Anomaa Studio
By listing a Digital Product, a Seller grants Anomaa Studio a limited, non-exclusive, worldwide, royalty-free license to reproduce, display, distribute, format, and create preview excerpts or thumbnails of the Listing Content, solely for the purpose of operating, displaying, and marketing the Listing on the Marketplace (including in search results, category pages, and promotional placements such as email or social media). This Marketing License ends when the Listing is removed from the Marketplace, except for residual copies retained in backups or records under the Data Retention Policy, or already distributed to a Buyer before removal.
7. Buyer's License to a Purchased Digital Product
Purchasing a Digital Product does not transfer copyright or other Intellectual Property Rights to the Buyer. Instead, the Buyer receives a license to use the Digital Product within the scope purchased. The available license types, permitted and prohibited uses, duration, and enforcement are governed entirely by the Licensing Policy and by the specific license tier stated on the Listing at the time of purchase — not by any general IP-transfer principle.
8. eBodhya™ Trademark Usage
"eBodhya," "eBodhya Marketplace," and the eBodhya logo are trademarks of Anomaa Studio. You may not use them to imply endorsement, sponsorship, or affiliation you do not have; to name a competing product or service; or in a manner likely to cause confusion. A Seller may reference "Available on eBodhya Marketplace" or similar factual statements to describe where their Digital Products are sold, provided this does not imply that Anomaa Studio endorses the specific content of the Listing beyond making it available for sale.
9. AI
AI Output generated by Marketplace features (recommendations, search ranking) is a Platform tool output owned by Anomaa Studio as part of the Marketplace's Intellectual Property Rights, and does not create any ownership interest in, or license over, the underlying Listing Content it references. See the AI Usage Policy.
10. Data Processing
Not separately applicable; see the Privacy Policy.
11. Cookies
Not separately applicable; see the Cookie Policy.
12. Third-Party Services
Where a Listing incorporates licensed third-party material (for example, stock imagery), the Seller — not Anomaa Studio — is responsible for ensuring that license permits resale through the Marketplace, as described in the Copyright Policy.
13. Security
Not separately applicable; see the Security Statement.
14. Retention
Copies of Listing Content retained for record-keeping, dispute defense, or backup purposes are retained per the Data Retention Policy.
15. Deletion
When a Listing is removed or a Seller Account is deleted, the Marketing License in Section 6 ends prospectively; see the Data Deletion Policy for the effect on already-purchased Buyer Licenses (unaffected) and retained records.
16. User Responsibilities
Sellers must ensure they hold sufficient rights to grant both the Marketing License to Anomaa Studio and the Buyer License described in the Licensing Policy. Buyers must use a purchased Digital Product only within the scope of the License they bought.
17. Prohibited Activities
You may not remove or alter copyright, attribution, or watermark notices on Listing Content; use the eBodhya™ trademark without permission; or claim ownership over Content you do not own. See also the Licensing Policy prohibited-uses list.
18. Limitation of Liability
Our liability in connection with IP ownership or licensing matters is limited as described in the Terms of Service.
19. Disclaimer
We do not independently verify a Seller's chain of title to Listing Content beyond the warranty in the Copyright Policy and the due diligence in the Copyright Takedown Policy.
20. Termination
The Marketing License in Section 6 terminates when a Listing is removed; Buyer Licenses already granted survive termination of the Seller's Account, as described in the Licensing Policy.
21. Governing Law, Jurisdiction, and Changes
Governing Law and Dispute Resolution
This Intellectual Property Policy and any dispute, claim, or controversy arising out of or relating to it, the Platform, or the Services (a "Dispute") is governed by the laws of India, without regard to its conflict-of-laws principles.
The parties will first attempt in good faith to resolve any Dispute through informal negotiation for thirty (30) days after one party gives the other written notice of the Dispute. If the Dispute is not resolved within that period, it will be referred to and finally resolved by arbitration in Bengaluru, Karnataka, under the Arbitration and Conciliation Act, 1996, before a sole arbitrator appointed by Anomaa Studio. The arbitration will be conducted in English, and the seat and venue of arbitration will be Bengaluru, Karnataka. The award of the arbitrator will be final and binding on the parties.
Nothing in this clause prevents either party from seeking urgent injunctive or equitable relief before a competent court at any time. Subject to the arbitration agreement above, the courts at Bengaluru, Karnataka shall have exclusive jurisdiction over any Dispute not subject to arbitration and over any proceeding to enforce an arbitral award.
Jurisdiction
Without prejudice to the arbitration agreement above, the Platform is directed at Users in India, and Anomaa Studio makes no representation that the Platform or its Content is appropriate or lawfully available in other locations. Users who access the Platform from outside India do so on their own initiative and are responsible for compliance with local law.
Changes to This Intellectual Property Policy
We may update this Intellectual Property Policy from time to time to reflect changes in the Services, Applicable Law, or our practices. We will post the revised version on the Platform with an updated "Effective Date" and, for material changes, will provide reasonable advance notice through the Platform, by email, or by an in-product notice, as appropriate to the change and the audience of the Platform. Continued use of the Platform after the revised Intellectual Property Policy takes effect constitutes acceptance of the changes. Where Applicable Law requires your express consent to a change (for example, a material change to how we Process Personal Data of a Child), we will seek that consent before the change takes effect.
